As a contractor I am responsible to make sure each of my employees has been properly instructed including making sure they fully understand all instruction even if it includes furnishing someone to interpet if neccesary, and to follow up to make sure the employee actually uses the tool to the proper methods and standards. THIS IS AN OSHA REQUIREMENT. I am not sure this happened in this case. We need less attorneys and more common sense these days.

So the guy knew about the technology, bought a saw without it (cost saving?), did something stupid then gets a big payout because the manufacturer did not forsee his stupidity? What next? It is time people start taking responsibility for their actions. No wonder the cost of product is so high-manufacturers have to cover the anticipated lawsuits. Even if the manufacturer is vindicated they have thousands or perhaps hundreds of thousands of dollars tied up just defending themselves. Get real people. Wish I was on that jury.
