As a Canadian lawyer who does a great deal of personal injury work, it always amazes me to hear of the damage awards that some US jurisdictions grant.
posted: 7:20 am on March 18thInitially, I was surprised to hear that the liability arises from the lack of a new technology. Given media sensationalism, I suspect that this news story isn't the whole story. There was likely more to establish the liability.
To people like Scorpion54: Keep in mind, the lawyer didn't give the $1.5 million award ... he got it for his client. A group of U.S. citizens, the jury, gave this man the money.
Besides, it will likely be overturned on appeal if the only basis of the claim was a lack of new technology.
