When a technology regarding safety becomes available it is imperative that it be implemented quickly. If it is made known to a manufacturer and he decides against the safety feature he becomes liable for an injury to his customer because he rejected something that could have prevented the injury.
posted: 8:52 am on May 6thAs I see it most manufacturers don't want to include the safety feature because of the additional cost. They only are thinking of today's profit, and not of the future profits, or liability. This seems to be the mind think of most businesses today. No planning for the future.
Both parties were responsible for what happened, but most of the responsibility should have been placed on the operator of the equipment for removing the safety guards. One guard should have been included that wasn't.
